Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Jimmy Pour ("we", "us", "our") governing your use of the Jimmy Pour mobile application, website, and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be of legal drinking age in your jurisdiction (for example 21 or older where U.S. alcohol laws apply, or the applicable legal age where you live) to create an account or use the Service. The Service involves content relating to alcohol and tobacco and is intended only for adults of legal age. It is not directed to children, and you may not use it if you are under the legal drinking age. By using the Service you represent that you meet this requirement.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly at support@jimmypour.com if you believe your account has been compromised. You may sign in using email and password, or through Sign in with Apple or Google, subject to those providers' terms.

3. Subscriptions, billing, and auto-renewal

Jimmy Pour offers an optional paid subscription ("Jimmy Pour Pro") that unlocks additional features. The following terms apply to paid subscriptions:

• Purchase and billing. Subscriptions are sold as auto-renewable in-app purchases and are billed through your Apple App Store or Google Play account. Payment is charged to that account at confirmation of purchase.
• Auto-renewal. Your subscription automatically renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Managing and cancelling. You can manage or cancel your subscription any time in your App Store or Google Play account settings. Cancelling stops future renewals; it does not retroactively refund the current period.
• Free tier and feature changes. A free tier is available. We may change the features included in the free and paid tiers, or the subscription price, on a going-forward basis; where required, price changes are subject to the platform's notice and consent rules.
• Refunds. Purchases are handled by Apple or Google, and refunds are subject to their policies. We generally cannot issue refunds directly for platform-processed purchases.
• Data retention by tier. Free and paid tiers may differ in how long session history remains visible in the app, as described on our pricing page and in the app. Deleting your account removes your data as described in Section 9 and our Privacy Policy.

4. Your content

You retain ownership of the content you create in the Service — your bottles, cigars, sessions, notes, ratings, reviews, photos, and similar material ("Your Content"). You grant us a limited, non-exclusive license to host, store, process, transmit, and display Your Content solely to operate and provide the Service to you and the people you choose to share it with (for example friends you invite to a session). You are responsible for Your Content and represent that you have the rights to it and that it does not violate these Terms or the rights of others.

5. Acceptable use

You agree not to: use the Service for any unlawful purpose or in violation of alcohol, tobacco, or other applicable laws; upload content that is illegal, infringing, or harmful; harass or harm other users; attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems; or promote sales of alcohol or tobacco to minors or in violation of law. We may remove content or suspend accounts that violate these Terms.

6. AI and third-party features

Some features rely on third-party services (for example AI providers for transcription and identification, music services, subscription management, and import from third-party sites). AI-generated output — including identifications, recommendations, recaps, and newsletters — may be inaccurate or incomplete and is provided for your enjoyment and convenience, not as professional, medical, or purchasing advice. Your use of third-party integrations may be subject to those third parties' own terms.

7. Intellectual property

The Service, including its software, design, branding, and content we provide (but excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms and any applicable app store rules. All rights not expressly granted are reserved.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any content or AI output will be accurate.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Termination

You may stop using the Service and delete your account at any time from Profile → Delete account in the app, at /account-deletion, or by emailing support@jimmypour.com. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. On deletion, we handle your data as described in our Privacy Policy.

10. Apple App Store — additional terms

If you download the app from the Apple App Store, the following also apply:

• These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
• Your license to use the app is a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• We, not Apple, are solely responsible for the app and for providing any maintenance and support for it. Apple has no obligation to furnish support.
• In the event the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• We, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory non-compliance, and consumer protection claims.
• We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government prohibited-party list, and you will comply with applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and post the new Terms in the app and on this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply.
